These Terms and Conditions ("Agreement") govern your access to and use of the website www.ArtisanEra.in ("Site"), owned and operated by Romulus Arts Private Limited, a company registered under the Companies Act, 2013, having its registered office in Delhi, India ("ArtisanEra", "Company", "we", "our", or "us").

This Agreement is a legally binding contract between you ("User", "you", or "your") and ArtisanEra. By accessing, using, registering, or placing an order on the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to be bound by all of the terms of this Agreement, do not use or access the Site.

1. ELIGIBILITY TO USE THE WEBSITE

1.1 You must be at least 18 years of age or the age of majority in your jurisdiction (whichever is greater) to use this Site. Use by persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 (including minors, un-discharged insolvents, and persons of unsound mind) is strictly prohibited.

1.2 We reserve the right to deny access to our Site or terminate your user account without notice if we reasonably believe you do not satisfy eligibility requirements.

2. SITE OWNERSHIP AND HOSTING

2.1 This Site is hosted on the Shopify.com platform. While Artisan Era is the sole owner and content controller of www.ArtisanEra.in, technical hosting, infrastructure, uptime, and certain data processing functions are managed by Shopify Inc.

2.2 Shopify is responsible for the underlying hosting environment, payment encryption mechanisms, and platform uptime. Artisan Era disclaims liability for any malfunction, downtime, or breach of platform security attributable to Shopify.

3. ACCOUNT REGISTRATION AND MEMBERSHIP

3.1 You may use the Site as a guest or create an account. If you choose to register:

  • You must provide accurate, current, and complete information.
  • You are solely responsible for maintaining the confidentiality of your login credentials.
  • You must notify us immediately of any unauthorized use of your account.

3.2 We reserve the right to suspend or terminate accounts that are inactive, incomplete, misleading, or in violation of this Agreement.

4. INVITATION TO OFFER

4.1 All information, product listings, and prices displayed on this Site constitute an “invitation to offer.” Your order submission represents a binding offer to purchase, subject to our acceptance.

4.2 We reserve the right to accept or reject any offer at our sole discretion, without obligation to assign any reason for the same.

5. PRODUCT INFORMATION AND ACCURACY

5.1 While we strive to provide accurate descriptions and pricing, occasional typographical errors, inaccuracies, or omissions may occur.

5.2 We reserve the right to:

  • Correct any errors or inaccuracies;
  • Change or update information at any time without prior notice;
  • Cancel orders where product or pricing information is incorrect, even after the order has been submitted, and refund any payment made.

6. PRICING, PAYMENT & TRANSACTION SECURITY

6.1 All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.

6.2 We accept multiple payment methods, including credit/debit cards, UPI, net banking, and cash on delivery (with additional handling charges).

6.3 Payment gateways such as RazorPay are used for processing online transactions. These third-party processors maintain PCI-DSS compliance. We do not store your card or payment details on our servers.

6.4 We reserve the right to refuse or cancel orders placed with incorrect billing or payment information or which appear suspicious or fraudulent.

7. SHIPPING, DELIVERY & TRACKING

7.1 We offer free shipping across India. A flat fee of ₹40 is applied for Cash on Delivery (COD) orders.

7.2 Orders are generally dispatched within 2–4 business days, with estimated delivery within 5–10 business days depending on location.

7.3 Tracking details will be emailed or messaged once the order is shipped. We are not liable for delays caused by logistics providers.

8. RETURNS, CANCELLATIONS & REFUNDS

8.1 We accept returns for damaged, defective, or incorrect products. Return requests must be initiated within 48 hours of delivery with supporting evidence (photos, etc.).

8.2 Cancellations are allowed only before dispatch. Post-dispatch cancellations for reasons other than non-fulfillment of order terms may not be accepted.

8.3 Refunds, where approved, will be processed within 7–10 working days via the original payment method or equivalent store credit.

9. REVIEWS, FEEDBACK & SUBMISSIONS

9.1 All content ("Comments") submitted by you, including reviews, feedback, suggestions, or other materials, become the exclusive property of ArtisanEra.

9.2 You grant us a royalty-free, perpetual, irrevocable right to use, reproduce, modify, publish, and distribute such content for any lawful purpose.

9.3 You represent that your submissions:

  • Do not infringe any third-party rights;
  • Are not defamatory, unlawful, obscene, or misleading;
  • Are free of malware, spam, or political propaganda.

9.4 We reserve the right (but not the obligation) to monitor, edit, or delete Comments that violate these terms.

10. INTELLECTUAL PROPERTY

10.1 All content on this Site—including images, illustrations, logos, text, product designs, software, and source code—is the intellectual property of Artisan Era or its licensors.

10.2 Unauthorized reproduction, duplication, or commercial exploitation of any content is strictly prohibited and may result in legal action.

11. COMMUNICATIONS

11.1 By using the Site or communicating with us via email or forms, you consent to receive communications electronically.

11.2 You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing.

12.3 We are not liable for any damages resulting from:

  • Actions or omissions of third-party service providers including Shopify, RazorPay, Shiprocket, etc.

13. LIMITATION OF LIABILITY

13.1 In no event shall ArtisanEra, its directors, employees, or affiliates be liable for any direct, indirect, incidental, punitive, special, or consequential damages, including but not limited to:

  • Loss of data;
  • Loss of profits;
  • Business interruption;
  • Personal injury or property damage;
  • Unauthorized access to or use of secure servers.

13.2 This limitation shall apply regardless of the form of action—whether in contract, tort, negligence, strict liability, or otherwise.

14. INTELLECTUAL PROPERTY AND FAN ART DISCLAIMER

14.1 Nature of Artworks Displayed

All artworks, illustrations, graphic designs, and visual content made available on www.ArtisanEra.in (the “Site”) are either:

(a) original works created by the in house design team of Romulus Arts Private Limited (“Artisan Era E-store”); or

(b) derivative fan art inspired by publicly known fictional universes including, but not limited to, movies, anime, comics, or video games. These artworks are created for artistic and decorative purposes only and are not intended to serve as replicas, reproductions, or official merchandise of any existing intellectual property, franchise, or registered trademark.

14.2 Non-Affiliation and No Infringement Intent

Artisan Era E-store expressly disclaims any affiliation, sponsorship, or endorsement by the original creators, copyright holders, or trademark owners of any third-party properties that may be visually referenced in our artworks. All trademarks, logos, and characters referred to on this Site are the property of their respective owners. Any resemblance to proprietary characters is purely artistic interpretation, and no claim of ownership over such properties is made or implied.

14.3 Respect for Intellectual Property Rights

Artisan Era E-store respects the intellectual property rights of all entities and individuals. If you are a rights holder and believe that any content hosted on this Site infringes upon your rights, please contact us at legal@ArtisanEra.in with relevant supporting documentation. We are committed to reviewing all claims in a timely and cooperative manner and, if appropriate, taking corrective action.

14.4 Prohibition on Unauthorized Use and Replication

All content hosted on the Site, including fan art and original designs, is the intellectual property of Romulus Arts Private Limited and/or its contributing designers. Unauthorized reproduction, distribution, modification, or commercial use of any artwork, whether in part or in full, without prior written permission from Artisan Era E-store is strictly prohibited and may give rise to civil and/or criminal liability under applicable laws including, but not limited to, the Indian Copyright Act, 1957.

14.5 Enforcement of Rights

Artisan Era E-store reserves the right to initiate legal proceedings—civil and/or criminal—against any third party found to be copying, redistributing, exploiting, or misappropriating its content or intellectual property in violation of these Terms. Such enforcement may include, without limitation, injunctions, monetary damages, and attorney fees to the fullest extent permitted by law.

15. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Artisan Era and its affiliates from any claim, loss, liability, damage, or expense (including attorneys' fees) arising from your:

  • Breach of this Agreement;
  • Violation of law or third-party rights;
  • Misuse of the Site or its content.

16. FORCE MAJEURE

We shall not be held responsible for any failure or delay in performance due to events beyond our reasonable control, including acts of God, natural disasters, epidemics, cyber-attacks, labour strikes, war, or government restrictions.

17. GOVERNING LAW & JURISDICTION

This Agreement is governed by the laws of India. Any disputes arising out of or related to this Agreement shall be subject to the exclusive jurisdiction of the courts in Delhi, India.

18. MODIFICATION OF TERMS

We reserve the right to change these Terms at any time. Updates will be posted on this page with a revised effective date. Continued use of the Site after such changes constitutes your acceptance of the modified Terms.
